LOVE GOLF FLEXICLUB TERMS AND CONDITIONS

ACCESS

1.1 These terms and conditions (Terms) set out the rules governing participation in Love Golf Flexiclub and access to the New Zealand Golf and LOVE Golf websites (www.golf.co.nz & www.lovegolf.co.nz).

1.2 Love Golf Flexiclub is brought to you by New Zealand Golf in partnership and association with DotGolf.

1.3 These Terms relate specifically to the Love Golf Flexiclub. They operate in addition to the standard terms and conditions governing usage of the New Zealand Golf website.

REGISTRATION

2.1 Entry is available to any person who is not currently a member of an affiliated New Zealand golf club.

2.2 Beginning 1 October 2018, any member of an affiliated New Zealand Golf club who has resigned is required to stand down for a period of 12 months before being eligible to join Love Golf Flexiclub, unless exempted which is at the full discretion of New Zealand Golf.

2.3 By registering you are becoming an affiliated member of New Zealand Golf implying full acceptance of these Terms, including any changes that may be made to the Terms from time to time.

2.4 To become a Love Golf Flexiclub member, the person must register and provide the information requested accurately. Personal information provided at the time of registration is presumed to be true and correct. It is your responsibility to update personal information as and when necessary.

2.5 Persons may only register once. Registration is for a single person only.

2.6 Love Golf Flexiclub members consent to the disclosure of their personal information, including but not limited to their name, email address, date of birth, and golf scores onto the New Zealand Golf and LOVE Golf websites, to any person who visits the New Zealand Golf or LOVE Golf websites, to New Zealand Golf, to suppliers of any prizes and to other sponsors of New Zealand Golf.

ANNUAL MEMBERSHIP

3.1 You agree to join Love Golf Flexiclub for the period of 12 months as specified on your application form.

3.2 Your Love Golf Flexiclub membership will continue indefinitely until cancelled and the recurring membership fee will be automatically deducted at the end of your current subscription period.

3.3 When you pay using your debit or credit card, the system automatically stores your credit card details to enable you to pay for the same / other services on the site. Credit card details are stored under heavy encryption by a third party payment provider, Payment Express, and not on the DotGolf system. Read the Payment Express Privacy Policy here.

MONTHLY MEMBERSHIP

4.1 You agree to join Love Golf Flexiclub as a monthly paying member as specified on your application form.

4.2 Your Love Golf Flexiclub membership will continue indefinitely until cancelled and the recurring membership fee will be automatically deducted at the end of your subscription period.

4.3 When you pay using your debit or credit card, the system automatically stores your credit card details to enable you to pay for the same / other services on the site. Credit card details are stored under heavy encryption by a third party payment provider, Payment Express, and not on the DotGolf system. Read the Payment Express Privacy Policy here.

MEMBERSHIP ENTITLEMENTS

5.1 As an affiliate of New Zealand Golf, your membership entitles you to an official New Zealand Golf handicap, a 7-digit ID number will provide you access to golf.co.nz, access to lovegolf.co.nz, access to New Zealand Golf App and Tee Booking App, and receive any benefits associated with New Zealand Golf promotions and New Zealand Golf’s partner promotions.

5.2 Previous members of golf clubs can obtain previous history of scores.

5.3 As a member of an official affiliated club of New Zealand Golf, you are entitled to an offer for affiliated green fee rates, noting an offer for affiliated green fee rates are at the full discretion of a golf club.

FEES

6.1 You agree to pay a joining fee, as set out on lovegolf.co.nz and on the Application Form (unless a ‘no joining fee’ promotion applies).

6.2 As Love Golf Flexiclub Annual Members, you agree to pay a 12-month subscription fee in advance as set out on our lovegolf.co.nz website and on the application form.

6.3 As Love Golf Flexiclub Monthly Members, you agree to pay a monthly subscription fee in advance as set out on our lovegolf.co.nz website and on the application form.

6.4 Fees will be charged and billed to your nominated debit/credit card.

6.5 As per clause 5.3, green fees will incur an additional fee and pricing of green fees is at the full discretion of every individual golf club.

6.6 There may be changes to your membership fees. If there are, we will give you at least 4 weeks’ notice before this takes effect.

OVERDUE PAYMENTS

7.1 If your credit card payment or direct debit payment hasn’t been processed, we will communicate with you to settle your account, so you can continue to receive the benefits of being a Love Golf Flexiclub member.

7.2 It is your responsibility to keep your account in funds and to pay all of your own bank fees, including any fees which your bank charges if your account is overdrawn because of our direct debit. If any of your direct debits or credit card payments fail, we will either add the outstanding sum to the next direct debit or make additional direct debits to recover the overdue amount.

7.3 If your account with us is more than 4 weeks in arrears, we will cancel your Love Golf Flexiclub membership, with or without notice.

8. OUR LIABILITY TO YOU

8.1 You have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Other than those rights and the rights given to you under this contract: we will not be liable to you for any direct, indirect or consequential loss or damage or injury of any kind to you or your property, however it arises. Compensation for personal injury by accident in New Zealand is covered by The Accident Compensation Act 2001;

8.2 We will not be obliged to give you any refund of fees paid for your membership if you fail to use your membership or terminate early, before the end of your subscription period.

9. CANCELLATION PROCESS

9.1 You may cancel your Love Golf Flexiclub membership at any time so your membership will expire on the next payment due date.

9.2 At any time, we can terminate your membership immediately by giving you notice in writing or by email if we reasonably believe you have seriously breached an important term of this contract, including:

1. if your account with us is more than 4 weeks in arrears
2. breaching any rules such as carrying out any illegal, offensive, or unsafe activity on the premises of any affiliated New Zealand Golf club.
3. If we do terminate your membership under this clause because of your serious breach of this contract, we are still entitled to recover our costs and losses under this contract.

10. TEE BOOKING

10.1 New Zealand Golf and DotGolf takes no responsibility for:

1. Failure of the customer to be at the golf course ready to play at the booked tee time for any reason whatsoever.
2. The condition of the golf course and any current work being undertaken (e.g. green coring and any other maintenance work).
3. Any dissatisfaction the customer may have with the Golf Course at which the round is booked or any member of their staff.
4. Any variation or mistake in prices quoted for any Golf Club on the site which to the best of the knowledge and belief of DotGolf are correct.
5. There will be no refunds available in these circumstances and no correspondence will be entered into.
6. At the time of booking a tee time your credit card payment will be pre-authorised. The Golf Club will charge your credit card on the day of your round or at a time shortly thereafter. A booking fee of $2.00 will still be charged in any of the following circumstances:
   • The Golf Course being closed for play at the time of your tee time.
   • If you have validly cancelled your tee time under clause 10.3
   • Exceptions may apply at some golf clubs who charge a green fee at the time of purchase and a booking fee may or may not be charged for these transactions.

10.2 You are entitled to cancel your booked tee time online at any time up to 11:59pm on the day being two days prior to the day of your booked tee time. Note that if you do cancel your booking after this time, you will be required to ring the golf club staff. Final discretion on whether you will be charged lies with the golf club, and policy differs from club to club.

10.3 You are entitled to cancel your booked tee times for other players. If you do that DotGolf will immediately email those player(s) (you must, as part of the booking process, provide email addresses for the other players). Depending on the policy of the golf club being booked at, those player(s) must accept and confirm the booking within 24 hours of receiving the email failing which the booking for those player(s) will be automatically cancelled.

10.4 If you intend to play with a member of the Golf Course at which you have booked, and there exists a members guest green fee rate, if the member does not play with you, you will be required to pay the full applicable non member guest rate.

10.5 If you are a junior player your credit card will be pre authorised for green fees as though you are a senior player. You must provide proof of your age to the Golf Course at which you are playing. This is likely to be a drivers licence, passport or student ID card with photo identification and date of birth. If you are able to prove you are a junior player to the satisfaction of the Golf Course at which you are playing then your credit card will be charged at junior rates. If you are unable to prove your age you will be charged at full rates.

11. CHANGES TO THESE TERMS

11.1 New Zealand Golf and DotGolf may change or delete any of these Terms at any time.

11.2 Love Golf Flexiclub members are responsible for checking the Terms regularly to review any such changes.

11.3 Continued participation in Love Golf Flexiclub following the publication of any changes to the Terms confirms participants acceptance of those changes.
